Article 1 – Purpose and definitions

These General Terms of Use (the “Terms of Use”) govern access to and use of the website https://savana-games.eu and its language versions (the “Site”), published by SAVANA (“SAVANA”).

“User” means any person who accesses the Site, regardless of their location and the means by which they connect. “Services” means all the features offered on the Site.

Use of the Site implies acceptance of these Terms of Use. Purchases made on the Site are also governed by the General Terms and Conditions of Sale, and the processing of personal data by the Privacy Policy.

SAVANA may amend the Terms of Use at any time; the applicable version is the one online at the time the Site is used.

Article 2 – Legal notice

Article 3 – Access to the Site and customer account

The Site is accessible free of charge to any User with Internet access; the costs of access (equipment, connection) are borne by the User. SAVANA endeavours to ensure that the Site is accessible at all times but may interrupt access, in particular for maintenance, without incurring any liability.

The User may create a customer account allowing them to view their orders and addresses. The User undertakes to provide accurate information and to keep their login credentials confidential. The User may request the deletion of their account at any time at contact@savana-games.com.

Article 4 – Personal data and cookies

SAVANA processes Users’ personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act (loi Informatique et Libertés). The data collected, the purposes of processing, the recipients, the retention periods, the use of cookies and Users’ rights are described in detail in the Privacy Policy.

Article 5 – Intellectual property

The general structure of the Site and all of its content (texts, illustrations, photographs, videos, logos, game names, trademarks, graphic design) are the property of SAVANA or its partners and are protected by intellectual property law. The “SAVANA” trademark is a registered trademark.

Any reproduction, representation, adaptation or exploitation of all or part of the Site or its content without the prior written authorisation of SAVANA is prohibited and constitutes infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code (Code de la propriété intellectuelle), subject to the exceptions provided for by law (in particular strictly private use and short quotations with acknowledgement of the source).

Use of the Site does not confer on the User any intellectual property rights in its content.

Article 6 – Liability

SAVANA takes care to ensure the accuracy of the information published on the Site but cannot guarantee that it is free from errors or omissions, which it undertakes to correct as soon as it becomes aware of them. Editorial content (in particular blog articles) is provided for information purposes.

SAVANA cannot be held liable for any damage resulting from an interruption of the Site, a malfunction of the Internet, an event of force majeure, the act of a third party or use of the Site that does not comply with these Terms of Use. It is the User’s responsibility to protect their equipment against viruses and intrusions.

The User is responsible for their use of the Site and undertakes not to interfere with its operation or infringe the rights of SAVANA or third parties.

These provisions do not limit SAVANA’s liability towards consumers beyond what is permitted by law, in particular under the General Terms and Conditions of Sale and the legal guarantees.

Article 7 – Hyperlinks

The Site may contain links to third-party websites, in particular retailers (Amazon, Fnac, Cultura, etc.) and social networks. SAVANA has no control over these websites and accepts no liability for their content; their own terms and privacy policies apply.

Creating a link to the Site is permitted, except from websites that disseminate unlawful content or content that is detrimental to SAVANA’s image; SAVANA may request the removal of any link at any time.

Article 8 – Governing law

These Terms of Use are governed by French law, without prejudice to the mandatory protective provisions of the country of residence of a User who is a consumer. In the event of a dispute, an amicable solution will be sought first, in particular through the consumer mediator mentioned in the General Terms and Conditions of Sale; failing this, the dispute may be brought before the competent courts under the conditions provided for by law.

The Terms of Use are drawn up in French; in the event of any discrepancy with a translation, the French version prevails.
